Terms of service
These Terms of Service (the "Terms") are a legal agreement between you and Power Rate Check LLC ("Power Rate Check," "we," "us," or "our").
They govern your access to and use of PowerRateCheck.com and our electricity plan comparison, recommendation, plan-review, alert, and related services (collectively, the "Service").
By using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
1. About Power Rate Check
Power Rate Check is a Texas-registered electricity broker that helps residential customers compare retail electricity plans. We are not a retail electric provider ("REP"), transmission and distribution utility ("TDU"), or government agency. We do not generate, sell, or deliver electricity, issue electricity bills, control outages, or determine a REP's credit or deposit requirements.
Power Rate Check is not affiliated with any REP as of the effective date of these Terms. If that changes, we will make the disclosures required by law.
2. Our Service
The Service allows you to compare electricity plans, receive recommendations, review or upload plan documents and electricity bills, request alerts, and follow links to REPs. Available features, plans, and providers may change and may vary by location.
If you choose a plan, we may direct you to the REP's website or another third-party website. Power Rate Check does not currently submit enrollments, switch your electricity service, or transmit your personal information to a REP on your behalf. You must review the REP's terms, confirm your information, and complete enrollment directly with the REP. If we later offer enrollment assistance, we will provide any additional disclosures and obtain any authorization required by law before acting on your behalf.
The REP has final authority to accept or reject an enrollment, determine eligibility, require a deposit, and establish the terms of retail electric service. Your electricity agreement is with the REP. The REP is responsible for that agreement, enrollment acceptance, billing, deposits, and cancellation matters. The applicable TDU is responsible for electricity delivery and responding to outages.
You may stop using the Service at any time. Price alerts and other optional communications may be stopped through the unsubscribe or management link provided with those communications. There is no termination fee.
3. Plan Information and Estimates
We use information provided by you and information obtained from REPs, public sources, and other third parties. Prices, availability, eligibility, and plan terms can change. We try to provide useful and accurate comparisons, but we do not guarantee that every available plan is included or that plan information is always complete, current, or error-free.
Projected bills, savings, rankings, and recommendations are estimates, not guaranteed prices or future bills. Actual costs may differ based on electricity usage, meter-read dates, taxes, TDU charges, eligibility, deposits, fees, price changes, and other factors.
Before enrolling, review the REP's current Electricity Facts Label, Terms of Service, Your Rights as a Customer document, and final enrollment disclosures. If our information differs from the REP's current documents, the REP's documents control your electricity service.
4. Compensation and Ranking Independence
Power Rate Check does not currently charge customers to use the Service. We may receive compensation from a REP, enrollment platform, or another third party if a customer enrolls after using the Service. Compensation may vary by provider or plan, and we may receive no compensation for some enrollments.
No REP or other party can pay to improve a plan's position in our recommendations. Compensation is not a ranking factor. Our recommendations use estimated cost for the usage you provide together with the eligibility, term, preference, and tie-breaking criteria applied by the Service.
5. Your Information and Communications
You agree to provide accurate information and confirm that you are authorized to make electricity-service decisions for the service address. You retain ownership of documents and information you submit. You authorize us to use that information as reasonably necessary to provide the Service, comply with law, and protect the Service, as described in our Privacy Policy.
We will not release proprietary client information to another person, or sell or make client-specific information available for sale, without written authorization, except for a disclosure to the PUCT or as otherwise required by law. We do not currently transmit your personal information to a REP when you follow a link from our Service.
If you request alerts or other communications, you authorize us to send them to the contact information you provide. You may unsubscribe from optional communications at any time.
Automated systems may extract or interpret information from documents you provide. Review any extracted or prefilled information before relying on it.
6. REPs and Other Third Parties
REPs, TDUs, enrollment platforms, and linked websites are independent third parties. We do not control their websites, security, eligibility decisions, prices, service, or performance. A reference or link to a third party does not imply ownership, endorsement, or affiliation unless we expressly say otherwise.
Questions or disputes about a REP's agreement, deposit, bill, enrollment, cancellation, or conduct should be directed to the REP or the appropriate regulator. Outages and delivery issues should be directed to the applicable TDU. Nothing in these Terms limits your right to complain to us, the Public Utility Commission of Texas ("PUCT"), or another government agency.
7. Acceptable Use and Ownership
You may use the Service only for lawful, personal purposes. You may not interfere with its operation or security, gain unauthorized access, introduce malicious code, scrape or copy content in bulk, reverse engineer the Service except where the law permits, impersonate another person, or use the Service or its original content to train or operate a commercial artificial-intelligence system without our written permission.
The Service, including its software, design, text, original explanations, cost models, and branding, belongs to Power Rate Check or its licensors and is protected by law. REP documents and other third-party materials remain the property of their respective owners. We grant you a limited, revocable, nontransferable right to use the Service for its intended personal purpose.
We may suspend access when reasonably necessary to address unlawful activity, misuse, fraud, security risks, or violations of these Terms.
8. Service Availability and Disclaimer
We may change, suspend, or discontinue features, correct errors, or remove plans or links that appear unavailable or inaccurate. We do not guarantee uninterrupted or error-free access.
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not guarantee that a recommendation will remain the lowest-cost option, that an estimate will match an actual bill, or that a REP will accept an enrollment on the displayed terms.
Nothing in these Terms limits an express promise we make, a nonwaivable consumer right, or liability that cannot lawfully be limited.
9. Limitation of Liability
To the fullest extent permitted by law, Power Rate Check and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, punitive, or consequential damages; lost savings, profits, or data; early-termination charges; or losses arising from the acts or omissions of a REP, TDU, enrollment platform, linked website, or other third party.
Our total liability arising from the Service or these Terms will not exceed $100. This limit does not apply to our fraud, gross negligence, willful misconduct, violation of a nonwaivable statutory duty, or liability that cannot lawfully be limited.
You are responsible for third-party claims arising from your unlawful use of the Service, intentional interference with the Service, or submission of material without the necessary rights. This does not apply to ordinary, good-faith consumer use or to claims caused by us.
10. Complaints and Disputes
Contact us at so we can investigate your concern. We will promptly investigate complaints and advise you of the result. Within 21 days after receiving a complaint, we will also provide information about the PUCT's informal complaint process.
You may contact the PUCT at any time:
Public Utility Commission of Texas, Customer Protection Division: P.O. Box 13326, Austin, Texas 78711-3326; 512-936-7120 or, in Texas, 1-888-782-8477; fax 512-936-7003; customer@puc.texas.gov; www.puc.texas.gov; Relay Texas 1-800-735-2989.
Nothing in these Terms requires a residential or small-commercial customer to arbitrate or mediate a dispute, restricts the right to complain to the PUCT or another agency, or waives a right that cannot lawfully be waived.
These Terms are governed by Texas law, without regard to conflict-of-law rules.
11. Privacy
Our Privacy Policy describes how we collect, use, disclose, protect, and retain personal information. It does not limit any privacy rights you have under applicable law. Agreement to these Terms does not replace any separate authorization or consent required by law.
12. Changes and General Terms
We may update these Terms by posting a revised version and changing the effective date. We will provide additional notice when reasonably appropriate for a material change. Changes apply prospectively. By continuing to use the Service after revised Terms take effect, you agree to the revised Terms.
These Terms form the entire agreement between you and Power Rate Check concerning the Service. A REP's documents separately govern your electric service. If any provision of these Terms is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. These Terms do not create a partnership, joint venture, employment, fiduciary, or agency relationship between you and Power Rate Check.
We may provide notices and records electronically. You may print or save a copy of these Terms. Questions may be sent to .
